Court Transfers Lagos-Calabar Coastal Road Suit to State High Court, Citing Lack of Jurisdiction

A Federal High Court in Lagos, presided over by Justice Akintayo Aluko, has ruled that it lacks jurisdiction to hear a lawsuit challenging the construction of the Lagos-Calabar Coastal road project. The suit, filed by residents of the Okun-Ajah community and property owners in Eti-Osa Local Government Area, was subsequently transferred to the Lagos State High Court.

The plaintiffs, representing the Okun-Ajah community, had sought to halt the road project, claiming encroachment on their properties and requesting damages. They named several defendants, including the Minister of Works, Dr. Dave Umahi, and various Lagos State officials.

The defendants, however, argued that the Federal High Court lacked jurisdiction over the case and requested its dismissal. Justice Aluko, after reviewing the arguments, agreed with the defendants.

While acknowledging the lack of jurisdiction, Justice Aluko opted to transfer the case to the Lagos State High Court, citing Section 22(2) of the Federal High Court Act, which allows for such transfers rather than outright dismissal. This decision ensures that the plaintiffs have the opportunity to pursue their claims in the appropriate court.
