Senator Omo-Agege kicks as court sacks APC excos in Delta

- Senator Ovie Omo-Agege has reacted to the nullification of the Jones Erue-led executive committee of the APC in Delta state

- A Federal High Court sitting in Asaba earlier sacked the Erue-led faction declaring that Cyril Ogodo-led faction of the party remains the authentic chairman in the state

- According to Omo-Agege, the consent judgement of a court in Abuja that gave validity to the Erue-led exco is final

Senator-elect and member representing Delta central senatorial district at the National Assembly, Ovie Omo-Agege, has reacted to the judgement of a Federal High Court sitting in Asaba on faction of the Jones Erue-led APC executive.

Justice Toyin Adegoke of the court on Monday, March 18, sacked the Jones Erue-led faction, declaring that Chief Cyril Ogodo-led faction of the party remains the authentic chairman in Delta state.

Leadership reports that Omo-Agege said the consent judgement from where the Erue-led executives emerged has not been challenged at a superior court adding that the judgement by Justice Adegoke is of no value.

The lawmaker in a statement signed by his senior special adviser communications & strategy to Senator Ovie Omo-Agege, Godwin Anaughe noted that the court erred in her judgement.

According to him, Omo-Agege and Rev. Waive because they were also not joined as parties to this present suit. Further to this, the Court, therefore, cannot make any declaratory orders against them. See Okonta Vs Philips (2010) 18 NWLR ( Pt 1225) 320 SC.

“Fourth, the national working committee of APC, under the directive of the NEC of the party is the only organ that is saddled with the responsibility of organizing party primaries for the purpose of nominating and sponsoring candidates for elections and not one Mefor Progress, an individual, as Justice Toyin Adegoke wrongly held in her judgement.

“Finally, it is imperative to state emphatically that the consent judgement of the Federal High Court sitting in Abuja that gives validity to the Jones Ode Erue-led Exco is a final judgement of Court like any other judgement, and it is valid and subsisting until it is appealed against and set aside by a court of competent jurisdiction.

“The Asaba Federal High Court lacks the jurisdiction to sit as an Appellant Court over a consent judgement delivered by a court of coordinate jurisdiction.

“Consequently Prophet Jones Ode Erue & his Exco remains the valid and authentic Executives of Delta State APC. The judgement delivered today by Justice Toyin Adegoke of the Federal High Court 1, Asaba is therefore of no consequence.”

Earlier, we reported that Senator Ovie Omo-agege second term ticket is threatened  as the Federal High Court sitting in Asaba, sacked the Jones Erue-led executive committee of the APC in Delta state.

The two-hour judgment of the court was presided over by Justice Toyin Adegoke upheld the Cyril Ogodo-led Delta APC faction in the state, declaring the executives as duly elected.

Justice Adegoke further held that all actions purportedly taken by the Erue-led executives were null and void, thereby nullifying the candidacy of the candidates who emerged from the primaries conducted by the Erue-led executives.
