The Court of Appeal sitting in Abuja has refused an application for stay of proceedings filed by the Chief Justice of Nigeria (CJN), Walter Onnoghen, against the Code of Conduct Tribunal (CCT).
The court said the charges filed against Onnoghen are criminal in nature and the proceedings before the CCT cannot be stopped.
It would be recalled that on Monday, the CCT has adjourned hearing in the case of false assets declaration filed against the suspended Chief Justice of Nigeria, Justice Walter Onnoghen, indefinitely.
The CCT Chairman, Danladi Umar, who announced the adjournment said it was in obedience to the interim order granted by the Court of Appeal, Abuja.
The appellate court had on Thursday ordered the tribunal to stay proceedings pending ruling on an application to stay proceedings filed by Onnoghen.
The tribunal had, on January 14, ruled that it had original jurisdiction to try the defendant.
Chairman of the tribunal, Mr. Danladi Umar, said it was obligatory for the tribunal to respect the “order of stay’’ made by the superior court.
“Following the January 24 order made by the Court of Appeal to stay proceedings here, the trial is adjourned sine die,’’ Umar said.
