Breaking News! Supreme Court Affirm Markafi Group As Authentic PDP Faction

Senator Ahmed Markefi is the authentic PDP national Chairman.

However, the supreme court pheld the May 21 National Convention in Portharcourt today in Abuja.

Supreme Court Update

1. The apex court has resolved the first of the two formulated issues against Modu Sheriff. The apex court held that the suit filed by Makarfi at the Federal High Court in P/H was not an abuse of court process as wrongly held by the majority judgment of the Court of Appeal, P/H.

Resolving the preliminary issue, the Supreme Court has dismissed the preliminary objection by the Ali Modu Sheriff faction, holding that the appeal by the Ahmed Makarfi faction was valid.

The second issue formulated is being considered by the Supreme Court. The issue is whether the PDP's National Convention held on May 21, 2016 and where Sheriff was removed as National Chairman of the party was illegal.

2. Reading the judgement, Justice Vivour explains how the national conventional should not have been disregarded by the appeal court.
The subject matter concerns Article 33 of PDP constitution which states:
There shall be a national convention…
All members of the party shall be bound by the decisions of leaders from the National convention.

Article 33 states the supremacy of the Natoinal convention.

Article 35 allows for the deputy national chairman.

Article 47 states the party may remove the Natoional leader after two years.

May is not the same thing as shall, the judge said. A national officer can be removed without a vote of no confidence.

There can be no doubt that the National convention has enormous powers over the party.

The decision of the National Convention stands, a fine of 250k awarded against Sheriff by the apex court.

The Markarfi led caretaker committee is authentic according to the Supreme Court.
